Note: A Certificate of Compliance for a solar installation can only be issued if there is a valid Certificate of Compliance for the property's entire electrical system. If you add a solar system to your home, the existing electrical installation must be certified as safe and compliant. Additionally, when buying a property, a general electrical Certificate of Compliance must cover any existing solar system, regardless of when it was installed.
Why Are Compliance Certificates Important?
Compliance Certificates are vital for several reasons. They protect homeowners and buyers by ensuring that all electrical work complies with safety standards, thereby minimising the risk of electrical hazards such as fires or electrocution. Moreover, insurance companies and financial institutions often require a valid Certificate of Compliance. Having one can help you avoid difficulties with insurance claims or mortgage bond approvals, which could have significant financial implications.
Despite these requirements, it's unfortunately quite common for Certificates of Compliance to be issued by individuals or companies that are not registered contractors with the Department of Labour or other regulatory bodies, such as the Bargaining Council for the Electrical Industry. This can lead to invalid certificates, non-compliant installations, and severe safety risks. Therefore, the benefits of Compliance Certificates are not just about meeting legal requirements; they are crucial for ensuring your and your family's safety and financial security.
Who Can Issue a Certificate of Compliance?
To be valid, the Certificate of Compliance must be issued by a registered electrical contractor who employs a qualified person to oversee the installation process. This person, a Master Installation Electrician or an Installation Electrician, must be on-site throughout the installation to ensure compliance with all relevant standards and regulations.
This emphasis on the role of qualified professionals in the installation process should give homeowners and property buyers confidence in their choices and peace of mind about the safety and compliance of their solar system. If a solar installer is not a registered electrical contractor, any Certificate of Compliance they issue is invalid.
What Does a Solar Certificate of Compliance Cover?
A solar compliance certificate only covers some solar systems. It pertains to the wiring and switchgear connecting the solar equipment to the property's electrical installation. This includes ensuring that all connections are safe and meet regulatory standards. By clarifying the coverage of a Solar Certificate of Compliance, homeowners and property buyers can feel informed and prepared, knowing what to expect and what additional steps may be necessary for their solar installation.
Note: Solar panels and batteries are deemed "fixed" appliances and are not covered by the Certificate of Compliance.
Different Levels of Electricians
It is essential to understand that not all electricians are qualified to install solar systems or issue Certificates of Compliance. In South Africa, there are three main types of electricians:
Master Installation Electricians (MIE): The most highly qualified electricians, MIEs, can oversee all electrical work and issue Certificates of Compliance for solar systems.
Installation Electricians: These professionals are qualified to undertake more advanced installations and can issue Certificates of Compliance for solar systems.
Single-phase Electricians: These electricians are limited to basic electrical installations and require supervision for more complex tasks.
Note: Only (1) Master Installation Electricians and (2) Installation Electricians and are authorised to issue valid solar compliance certificates.
Validity of a Solar Certificate of Compliance
Like any other Certificate of Compliance, a Solar Certificate of Compliance is only valid for two years, provided no modifications have been made to the installation since the certificate was issued. If a solar installation occurs after a property purchase and within two years of the original electrical Certificate of Compliance being issued, a supplementary Certificate of Compliance is required.
Note: A Solar Certificate of Compliance is separate from a general Electrical Certificate of Compliance. Both certificates must be presented to the conveyancers before a property registration can proceed.
Future Considerations for Solar Installations
As solar energy becomes more prevalent, solar installations are anticipated to feature more prominently in the mandatory Iimmovable Property Condition Reports required by the Property Practitioners Act 22 of 2019, which will, in all likelihood, affect both the sale and lease of immovable property.
